At its January 2006 meeting, the CRC:
- Adopted for public
hearing NCAC 7H .0312, Technical Standards for Beach Fill Projects, which outlines
sediment criteria rules for beach nourishment projects.
- Adopted for public
hearing amendments to NCAC 7J .0204 and NCAC 7I .0401, which would increase the
application fee for CAMA minor permits from $100 to $200, along with administrative
changes to 7I and 7J as they relate to the Minor Permit program.
- Adopted for public
hearing an amendment to NCAC 7B .0801, Public Hearing and Local Adoption Requirements, to
include the public opportunity to provide written comments following local adoption of a
land use plan.
- On the recommendation
of the Planning and Special Issues Subcommittee, the commission voted to certify a Land
Use Plan amendment for the Town of Oak Island.
- Approved the 2004-05
Coastal Habitat Protection Plan annual report.
- Granted a variance to
Leo and Carolyn Nowak of New Hanover County, who sought relief from the commissions
30-foot buffer rule to build a single-family residence with decking in Carolina Beach. The
proposed deck would have exceeded the limit of 200 total square feet of decking. The
variance is granted on the condition that the house is moved 2.4 feet towards the street
in order to bring the decking in line with the neighboring property to the south. An
engineered stormwater management system will be installed at the site.
- Granted a variance to
Charles and Ellen Darrigrand of Brunswick County, who sought relief from the
commissions rule requiring the use of a pre-nourishment static vegetation line to
calculate setbacks in order to construct a single-family residence on a lot in Oak Island.
- Granted a variance to
Jessie and Myers Construction, agents for Carlton and Julie Fisher of Brunswick County,
who sought relief from the commissions 30-foot buffer rule to build a single-family
residence in Ocean Isle Beach. An engineered stormwater management system will be
installed at the site.
- Denied a variance to
Carol Ann Zinn of New Hanover County, who sought relief from the commissions 30-foot
buffer rule to construct a swimming pool and concrete apron on a property in Wrightsville
Beach.
- Denied a variance to
Joseph Diello of Craven County, who sought relief from the commissions impervious
surface limits to build a sunroom addition on a single-family residence in New Bern.
- Upheld an
administrative law judges decision in the case of Gregory v. Division of Coastal
Management and Intervenor-respondent Swearingen. The petitioner disputed the DCMs
finding that repairs to a neighbors hurricane-damaged boathouse were exempt from
CAMA permit requirements under the 50 percent repair/replacement rule. The ALJ found in
favor of the petitioner and concluded that DCM erred in issuing the exemption.
- Denied a request
for a declaratory ruling concerning the commissions urban waterfront rules at a
project in Carolina Beach. The project involved replacing an old restaurant located
partially over the water with a six-story mixed-use structure, and expansion of the
structures original footprint up to 15 feet on the landward side.
- Denied a petition
for rule making filed by NC Floating Docks and Lifts, LLC. The petitioner requested that
he CRC amend its docks and piers rule to provide an exemption for floating boat lifts.
