November 2005 Coastal Resources Commission Actions

At its November 2005 meeting, the CRC:

  • Adopted an amendment to 15A NCAC 07H.0304 to remove the unvegetated beach designation from oceanfront areas in New Hanover, Pender, Carteret, and Onslow counties.

  • Adopted an amendment to the commission’s rule that prohibits concrete driveways in the oceanfront setback (15A NCAC 07H.0309). The amendment will allow the use of concrete, asphalt or turfstone for driveways in the oceanfront setback so long as the development does not directly abut the ocean and is located landward of a paved public street or highway currently in use. 

  • Adopted an amendment to NCAC 7O.0105 to add the Bird Island and Emily and Richardson Preyer Buckridge Coastal Reserves to the list of sites included in the N.C. Coastal Reserve complex.

  • Adopted an amendment to CAMA Land Use Planning Guidelines (15A NCAC 7B.0801, 7B.0802, 7B.0901) to create an exception that allows plans created under the old 7B rules to be amended according to the rules in effect at that time, to require a local resolution of adoption, and other minor changes.

  • Adopted an amendment to the Definition of Public Trust Areas (15A NCAC 7H.0207) to make a consistent reference to normal water levels instead of mean water levels.

  • Adopted an amendment to Building Code Standards in Ocean Hazard Areas (15A NCAC 7H.0308) correcting a reference to the NC Building Code.

  • Adopted for public hearing an amendment to increase the fees charged for CAMA general permits.

  • Adopted for public hearing an amendment to NCAC 7K.0208 to standardize the rule’s language to be consistent with other current CRC rules and to add a time requirement for project construction.

  • Appointed William Gardner Jr., Gary Greene, J. Michael Moore, David Nash, Rhett White, and Don Yousey to the Coastal Resources Advisory Council.

  • Granted a variance to Alton and Phyllis Smith of Carteret County, who sought relief from the commission’s 30-foot buffer rule to construct a single-family residence and driveway near Beaufort.

  • Granted a variance to Mike and Hortense Xenakis of Brunswick County, who sought relief from the commission’s 30-foot buffer rule to construct a swimming pool and deck on their property in Holden Beach.

  • Granted a variance to the Town of Emerald Isle et al, who sought an extension for sandbag permits protecting structures on properties located at “The Pointe” adjacent to Bogue Inlet.

  • Denied a variance to Fisherman’s Cove OIB, LLC of Brunswick County, who sought relief from the commission’s 30-foot buffer rule to construct 150 square feet of open decking attached to a recently permitted house in the Town of Ocean Isle Beach.

  • Denied a variance to Jessie & Meyers Construction of Brunswick County who sought relief from the commission’s 30-foot buffer rule to construct a single-family residence in the Town of Ocean Isle Beach.

  • Granted a variance to Dr. Stuart Point for Point Clan, LLC of New Hanover County who sought relief from strict application of the commission’s “one-quarter rule” for piers in order to extend a pier to the ACOE’s right of way in Masonboro Sound.

  • Rejected an administrative law judge’s decision in the case of Darrigrand v. Division of Coastal Management. Issued final agency decision denying variance request to construct single family residence within the 60-foot erosion setback at Oak Island.
