At its March 2007 meeting, the CRC:
Adopted for public hearing amendments to 15A NCAC 7J .0409, Civil
Penalties. The changes are necessary to implement the increase in civil penalties for CAMA
violations as authorized by the General Assembly.
Directed DCM staff to develop a set of policy changes for
development along shorelines affected by static lines, working in concert with affected
local governments and the CRC Science Panel.
Appointed Frank Rush, Town Manager for the Town of Emerald Isle,
to the Coastal Resources Advisory Council.
Voted to pass a resolution stating the Commissions
opposition to federal funding for the U.S. Navys proposed outlying landing field in
eastern North Carolina.
Granted a variance request from William and Heather Maxwell of
Dare County, who sought relief from the commissions 30-foot buffer rule in order to
construct a 20-foot-wide driveway on their property in Manteo.
Granted a variance to Circa Development, Inc. of Brunswick
County, who sought relief from the commissions
setback rule in order to construct a pedestrian beach accessway from an 18-lot subdivision
over the frontal dune to the ocean beach. The Commissions rules allow beach
accessways within the oceanfront setback, but such structures must be located landward of
the vegetation line. In this case, the property is subject to a static vegetation line
located behind the frontal dune.
Denied a variance to Dunlap Forestry, LLC of Brunswick County,
who sought relief from the commissions 30-foot buffer rule in order to construct a
single-family residence on a lot in Ocean Isle Beach.
- Granted a variance to the Nags Head Inn of Dare County, who applied
to modify a CAMA permit to construct new, detached balconies on the west side of the
property. The proposed modification would allow the balconies to be attached to the
structure using cantilevers. The variance stipulates that the balconies may never be
enclosed.
