At its May 2007 meeting, the CRC:
Adopted amendments
to 15A NCAC 7J .0210 Replacement
of Existing Structures, which would clarify
the methods for determining fifty percent damage, and state that connected but
functionally independent structures will be treated separately. The proposed changes also
create a distinction between water dependent and non-water dependent structures. DCM will
use different methods for determining value and repair versus replacement for these
different categories of structures.
Adopted amendments
to 15A NCAC 7K .0209 Exemption/Accessory Uses/Maintenance Repair /Replacement, which is
being amended to include a citation to the conditions contained within 07J .0210.
Adopted amendments
to 15A NCAC 7M .0303, .0306,
.0307 Public Access Guidelines; Local & State Involvement; Grant Eligibility &
Selection, which would change
the CRCs shorefront access policies, particularly to the Public Beach and Coastal
Waterfront Access Program. The primary changes are a reduction in the match requirement
from economically-distressed communities, and more flexibility in the source of their
match obligations.

to 15A NCAC 7H .1102, .1202, .1302, .1402, .2002, .2102, .2202, .2402, .2702, Increase
Time Allowance for Construction Under General Permits, which would extend the time allowed
for construction from 90 days to 120 days for certain types of projects.

hearing amendments to 7B. 0802 LUP Presentations, which eliminate the requirement for
local governments to present their land use plan in person to the Commission.

hearing amendments to 7M. 0300 Shorefront Access Policies, which would establish a
reporting requirement for user fees collected at state-funded access sites; give DCM the
ability to take the lead in acquiring land and constructing access facilities without a
city or county applicant; and includes provisions to utilize funds outside the usual
funding cycle in order to take advantage of unique opportunities.

hearing amendments to 7H .0308 Specific Use Standards for Ocean Hazard Areas, which would
allow the Commission to renew a permit for an erosion control structure issued pursuant to
a variance, as long as the structure is not enlarged beyond the dimensions set out in the
permit.
On the
recommendation of the Planning and Special Issues Subcommittee, the commission voted to
certify a Land Use Plan for Currituck County.
On the
recommendation of the Planning and Special Issues Subcommittee, the commission voted to
certify a Land Use Plan for the Town of Cape Carteret.
Denied a variance
to William and Betty Goforth of Brunswick County, who sought relief from the
commissions setback rule in order to construct a single-family residence in Oak
Island. The petitioners proposed development does not meet the required setback from
a pre-nourishment project vegetation line.
Granted a variance
to East Carolina Radio, Inc. of Dare County, who sought relief from the commissions
30-foot buffer rule in order to replace an existing radio tower and associated guy wires
and anchors. One of the proposed anchors and part of the access road lies within the
buffer.
Denied a variance
to Generation Builders, Inc. of New Hanover County, who sought relief from the
commissions pier length rules in order to construct an access pier and associated
structures as part of a multi-slip docking facility. The projects total length is in
excess of that allowed by the commissions pier length rules.
Voted to reconsider a variance issued to B & D Investments,
LLC, in response to an order of the superior court finding that two third party
petitioners had a right to present evidence on the facts.
Passed a resolution
supporting HB 1128, An Act to Appropriate Funds to Hyde County for the Last Commercial
Fishing Facility in Ocracoke.
