At its July 2007 meeting, the CRC:
Adopted amendments to 15A NCAC 7J .0701 Variance Petitions, which
requires claimants to initially file either a variance request or a contested case, and
not pursue both options at the same time.
Adopted amendments to 15A NCAC 7J .0702 Staff Review of Variance
Petitions, which outlines procedures for staff review, including the timing and
preparation of stipulated facts and staff recommendations.
Adopted amendments to 15A NCAC 7J .0703 Variance Procedures for
Deciding Petitions, which outlines procedures for
situations in which the Commission cannot reach a final decision due to incomplete
stipulated facts.
Approved for public hearing amendments to 15A NCAC 7H .1200 &
7H .0208(b)(6) Docks and Piers, which would give homeowners flexibility in the type and
square footage of pier structures, while at the same time providing more protection to the
marine habitat by reducing the maximum allowable shaded impact.
Approved for public hearing amendments to 15A NCAC 7H .0209(g)
Urban Waterfronts, which would limit non-water dependent structures over public trust
waters in designated Urban Waterfront areas.
Approved for public hearing amendments to 15A NCAC 7H .0312
Sediment Criteria, which makes some technical changes related to the depth of the active
beach profile, the definition of submarine borrow site, and other minor
changes.
Approved for public hearing amendments to 715A NCAC H .0305
General Identification and Description of Landforms, to define a static vegetation
line, and to allow exemptions from the static line under certain conditions.
Approved for public hearing amendments to 15A NCAC 7H .0306
General Use Standards for Ocean Hazard Areas, to tie beachfront building setbacks to the
size of the structure, and not the use. The revisions include graduated setback factors
for buildings greater than 5,000 square feet, and do not allow for cantilevering oceanward
of the setback line.
On the recommendation of the Planning and Special Issues
Subcommittee, certified a Workbook Land Use Plan for the Town of Bath.
On the recommendation of the Planning and Special Issues
Subcommittee, certified a Land Use Plan for the Town of Manteo.
Approved the 2007-2009 CHPP Implementation Plan.
Denied a variance to John Mohr of Brunswick County, who sought
relief from the commissions 30-foot buffer rule in order to construct a
single-family residence on a two-canal lot in Ocean Isle Beach.
Denied a variance to Greg LeNeave of Brunswick County, who sought
relief from the commissions 30-foot buffer rule in order to construct a
single-family residence on a two-canal lot in Ocean Isle Beach.
Upheld an administrative law judges decision in the case of
Robert D. Bryant v. Division of Coastal Management. The petitioner sought to block the
construction of a dock on a neighboring property in Sneads Ferry. The petitioner contended
that the dock would violate the CRCs rule that a dock may be no longer than ¼ the
width of the waterway, and would thus be an impediment to navigation. The ALJ found in favor of the petitioner.
Upheld an administrative law judges decision in the case of
Robert Don Foster/Andrew Price v. Division of Coastal Management. The petitioner sought to
block the construction of a single-family home on a neighboring property in New Hanover
County. A permit for the property was issued by DCM, using the small house
exception to allow construction within the 30-foot buffer. The ALJ found in favor of the petitioner.
