In the case of Donaghue v. DCM, upheld the Administrative Law Judge’s decision that DCM improperly issued a Notice of Violation for unpermitted development of a 62-foot pier on a residential property located within the Ocean Hazard Area of Environmental Concern and adjacent to Bogue Inlet. Petitioners contended, and the AlJ agreed, that the reconstructed structure was simply “repair” of the previous structure and so did not require a permit.

Granted a variance to Parker Overton of New Hanover County, who sought a variance from the Commission’s rules regarding the removal of a sandbag structure in front of a lot where the imminently threatened structure has been removed. The sandbags are part of a larger sandbag revetment that extends along contiguous properties in the area, and causing a small gap in the structure now, before removal of the adjoining sandbags can be required, is against the spirit of the CRC’s rules. The variance is conditioned on removal of the dog fence and associated concrete pilings and support which remain on the property.

Directed the Division of Coastal Management to delay enforcement actions regarding removal of sandbag structures until the Commission’s next meeting on Sept. 16.
