CRC repeals exemption for certain bulkheads, riprap and piers
The N.C. Coastal Resources Commission has voted to repeal the CAMA permit exemption for
certain bulkheads, riprap and pier projects. The repeal took effect Aug. 1, 2002.
Exemption repeal will not affect many bulkhead, riprap or pier projects
Previously, there was no fee for bulkheads, riprap and piers that meet certain
exemption criteria [15A NCAC 7K .0203], but the staff time involved in authorizing these
structures is similar to that of a general permit. A site visit is always required, and
proper written authorization must be given to the applicant. Projects that previously
qualified for an exemption can be authorized under a CAMA general permit.
The DCM staff does not issue many exemptions for bulkheads, riprap or piers, so
eliminating this type of authorization should not create any significant hardship to the
public. The staff estimates that only 5 percent of bulkhead, riprap and pier projects are
authorized under the exemption. The remaining 95 percent are authorized by permit. General
permits for bulkheads, riprap and piers cost $100.
Public hearing held in January
The CRC held a public hearing on the proposal on Jan. 23 at Elizabeth City State
University, and written comments were accepted through Feb. 1.
